Terms & Condition

Cloudvaio (a Unit of Softox Technologies) Web Hosting Services to clients worldwide, and we have a responsibility to protect each client and to provide the best Services available. All clients of Cloudvaio Cloud are subject to accept the following terms of Service:

Payments

You agree to pay for the Services on time and in advance for the billing cycle Services are provided for. Invoices are generated 10 days before the renew date of Hosting services and 30 days before for domain renewal. Cloudvaio provides 5 days grace period after the renew date. If the invoice is not paid within the 3 days grace period Cloudvaio will temporary suspend services until the invoice is paid in full. Cloudvaio will notify you upon Invoice generation via SMS (Only for India) and E-mail.

We accept payments via Razorpay, Cashfree and Stripe payment gateway for Indian clients while we have PayPal and Stripe for clients outside India. We do not accept payments from paypal accounts which are not verified.

Service Activation

  1. Order verification: If our system detects issue with your payment, we will contact you with steps and details to complete the verification process.
  2. Domain activation: Cloudvaio provides instant activation/registration for every domain purchased. We do not provide premium domains, if any domain which shows available and is premium will not be registered.
  3. Shared hosting activation: Cloudvaio provides instant account activation for our shared hosting plans.
  4. Cloud servers: Servers are instantly activated upon deploying from Cloudvaio cloud console.
  5. Every account may take more time to be activated if it fails the initial verification. If this happens, we will contact with more details to complete the verification.

Service Cancellation

Cancellation requests need to be placed from your client area by clicking on My services, then on Manage and then on the Request cancellation button. Cloudvaio will not аccept cancellation requests via email and you will be billed again for the Services until a legitimate cancellation request is placed.

No cancellation or refund for domains, service license(s) and other addons.

If your domain was registered with Cloudvaio and has expired, but you wish to recover the domain, Cloudvaio may be able to recover the domain if it is still within the redemption period. To recover a domain name that has expired but which is still within the redemption period, the customer has to pay a redemption fee. Please note that this domain redemption fee does not include the registration price of the domain that will still need to be paid to register the domain for the next year.

Service Termination

Shared hosting: Accounts that are 30 days past due will be automatically deleted from our servers. No backups will be provided.

WordPress hosting: Accounts that are 30 days past due will be automatically deleted from our servers. No backups will be provided.

Reseller hosting: Accounts that are 45 days past due will be automatically deleted from our servers. No backups will be provided.

Cloud servers: – If you have no backup for your VPS or dedicated server, we will not be able to provide you a backup by any circumstances.

Service Backups

Cloudvaio takes backups thrice a week for all Shared hosting plans. Your use of our backups is at your sole risk. We do not charge to restore / give backup. Cloudvaio is not responsible for the data residing on your account. Cloudvaio does not provide backups for the Cloud or Storage servers.

Banned Scripts

The following scripts are banned from use on our servers and may not be uploaded or run. Reasons for banning them include adverse effects on server load, invitations to hackers/spammers/criminal activity, etc.

  • IRC egg drops
  • Proxy servers
  • Mail bombers
  • Anonymous mailers
  • IP spoofers
  • Port scanners
  • Hivemail
  • Telnet or SSH Access Scripts
  • Nph-proxy (and other scripts what operates like proxy)
  • UBB (Ultimate Bulletin Board, all versions)
  • cgi
  • PhpShell
  • cgi, FormMail.pl from Matt’s Script Archive are not allowed.
  • Torrents
  • Phishing
  • Pornography

Nulled Scripts, Plugins, Themes

We strictly not allow any type of nulled content including nulled plugins, themes or any script which is pirated or nulled in our servers. If we find any site invovled in using nulled content we will be forced to suspend / terminate your account without refund.

Note: Using nulled scripts may result in hack of your site and break down your site security, in this case we will not be responsible from any point!

If your account gets suspended three times due to any of the above scripts, we will be forced to suspend/terminate your account without refund.

Service Monitoring

Shared hosting: We monitor our shared hosting servers 24/7/365 days a year.

Cloud servers: We provide monitoring for the cloud servers which can be ordered as addon with your cloud servers and additional fee will be applied. If we detect any issues we will open a ticket with detailed explanation of the problem.

Data Migration

We provide free migration for the accounts which use cPanel. If something is wrong with the account after the move and it wasn’t moved correctly it is your responsibility to fix it. If you don’t provide root access to the remote server from which we have to transfer your accounts, we can transfer for free up to 5 accounts per service. For every other account over 5, we will charge you extra depending on disk usage.

Account Security and Company Systems

(i) You are responsible for any misuse of your account therefore, you must take steps to ensure that others do not gain unauthorized access to your account. In addition, you may not use your account to breach the security of another account or attempt to gain unauthorized access to another network or server.

(ii) Your password provides access to your account. It is your responsibility to keep your password secure.

(iii) Sharing your password and account access with unauthorized users is not recommended. You should take care and prevent others from using your account since you will be responsible for the consequences.

(iv) Attempting to obtain another user’s account password is strictly prohibited, and will result in termination of service.

(v) You must adopt adequate security measures to prevent or minimize unauthorized use of your account.

(vi) You may not attempt to circumvent user authentication or security of any host, network or account. This includes, but is not limited to, accessing data not intended for you, logging into or making use of a server or account you are not expressly authorized to access, or probing the security of other networks. Use or distribution of tools designed for compromising security is prohibited. Examples of these tools include, but are not limited to, password guessing programs, cracking tools or network probing tools.

(vii) You may not attempt to interfere with service to any user, host or network (“denial of service attacks”). This includes, but is not limited to, “flooding” of networks, deliberate attempts to overload a service, and attempts to “crash” a host. Users who violate systems or network security may incur criminal or civil liability. Cloudvaio will cooperate fully with investigations of violations of systems or network security at other sites, including cooperating with law enforcement authorities in the investigation of suspected criminal violations.

(viii) It is your duty to make sure all the programs/scripts installed under your hosting account are secure and permissions of directories are set properly, regardless of the installation method. When at all possible, set permissions on most directories to 755 or as restrictive as possible. Users are ultimately responsible for all actions taken under their account. This includes the compromise of credentials such as username and password. You are required to use a secure password. If a weak password is used, your account may be suspended until you agree to use a more secure password. Audits may be done to prevent weak passwords from being used. If an audit is performed, and your password is found to be weak, we will notify you and allow time for you to change or update your password before suspending your account.

(ix) Any account found connecting to a third party network or system without authorization from the third party is subject to suspension. Access to networks or systems outside of your direct control requires the express written consent of the third party. We may, at our discretion, request documentation to prove that your access to a third party network or system is authorized.

(x) Any account that is found to be compromised may be disabled and/or terminated. If you do not clean up your account after being notified by us of an ongoing issue, we reserve the right to keep your account disabled. Upon your request, we may clean-up your account for an additional fee.

(xi) We reserve the right to migrate your account from one data-center to another in order to comply with applicable data center policies, local law or for technical or other reasons without notice.

Upgrade & Downgrade of Existing or Purchased Plans

  • (Once a plan has been purchased, downgrading to a lower tier or level is not permitted.
  • The decision to purchase a specific plan implies acceptance of its terms and conditions, including the understanding that downgrades are not allowed.
  • Upgrades or changes to higher-tier plans may be available, subject to the terms and conditions
  • Cloudvaio reserves the right to modify or update the plans and their features, but such changes will not result in involuntary downgrades for existing customers.

Additional IP

We provide additional IP addresses for our Cloud servers. Cloudvaio provides dedicated IP for shared hosting. We can provide up to 10 IP addresses per Cloud server, and we may require additional information for what the IP addresses will be used.

Additional IP address used to send spam will be suspended immediately.

Server Uptime

Cloudvaio provides 99.9% uptime (The required updates and the hardware maintenance are not counted as downtime. We will inform you before every update or maintenance of our services)

Price Change

The prices of our services may be changed from time to time depending on our vendor’s pricing. We are authorized partners of multiple license providers and domain registrars. If there’s any change in their pricing structure, we will be forced to increase the prices of our services to cover our costs. You are required to review billing information from time to time to avoid any surprise pricing.

Support Abuse

We always treat our customers with utmost respect and expect the same from you too. If our staff feels that you are consistently addressing them in a demeaning or rude manner, your account may be suspended and you may be asked to take your business elsewhere. In the event that we terminate service for support abuse, customers will be given ten (10) days’ notice to find a new host. No Refund Applicable.

Defamation

Cloudvaio is committed to providing a safe and respectful environment for all its clients and employees. We expect all clients to act responsibly and treat each other with respect. Defamation, which includes making false statements about Cloudvaio with the intention to harm reputation, is strictly prohibited. If any activity found client will be given 7 days time to moveout data and contract will be terminated on 7th day Cloudvaio reserves the right to terminate the hosting services and any active services.

Changes in Terms of Service

Cloudvaio may without advance notice change this Agreement from time to time, and will do so by posting the new Agreement on the Cloudvaio web site in place of the old. Customer agrees to visit the terms of service regularly for updates.
